That's why federal hours of service (HOS) laws limit the number of hours they can drive and require them to take mandatory rest breaks.   • Hours of Service Log: Truckers are required to prove they are in compliance with federal regulations by keeping a log of their service hours. We will secure this log and review it to make sure those mandatory breaks were taken.
  • GPS Data: Many commercial trucks have a "black box" that can tell us the truck's speed and direction of travel. This information may point to inaccuracies in the HOS log. For instance, the GPS data may show that the truck was moving when the driver was ostensibly taking a break.
  • Accident Scene: Drivers who fall asleep at the wheel normally don't hit the brakes before impact. That means there are no skid marks. Our investigation of the accident scene may provide key evidence in that regard.
  • Witness Testimony: Someone who saw the crash itself may be able to testify that the trucker appeared to be driving erratically, such as crossing the center line. Or someone who saw the trucker prior to the crash may testify that he or she appeared tired.
